The Act is law, and it sets out the rights, the responsibilities, and the duties of all parties in the workplace. It defines workplace hazards and provides enforcement of the law where compliance has not been achieved voluntarily by workplace parties.
What the Law Requires
The Occupational Health and Safety Act came into effect in 1979. Changes made in 1990 and subsequent years have continued the evolution of occupational health and safety legislation. With these changes have come strengthened requirements for health and safety in Ontario workplaces. It has reinforced the Internal Responsibility System (IRS) and the workplace structures, in particular the joint health and safety committees/health and safety representatives.
The Act clearly notes that the employers have the greatest responsibilities with respect to health and safety in the workplace. The Act also states that all workplace parties have a role and responsibility for promoting health and safety in the workplace. It is the collaborative promotion of workplace health and safety by employer and workers that is the basis for the IRS where everyone in the workplace has a role to play.
